Immigration Options For Applicants Waiting For CEC-Only Draw. On November 9, the latest Express Entry draw invited 4,750 candidates from all Express Entry programs, including Federal Skilled Worker, Canadian Experience Class (CEC), and Federal Skilled Trades. The cut-off threshold for this draw was 494 CRS points. 

As cut-offs continue to stay high for Express Entry, several international students and work permit holders are hoping for Canadian Experience Class-only draws. Although, it remains uncertain whether there will be a CEC-only draw. Or there will be options for international students and work permit holders, as emphasized by Immigration Minister Sean Fraser in his recent report.

Understanding the CRS breakdown 

The CRS score cut-off in the last two Express Entry draw finally dropped below 500 points. However, given previous trends, the CRS score cut-off will likely stay high for the upcoming draws, given that CRS only dropped by 2 points in the latest draw.

However, no one can accurately predict all upcoming CRS score cut-offs. It is because many distinct factors affect the CRS score cut-off; each factor remains unpredictable and impacts the cut-offs in various ways. These factors are: 

• The number of candidates invited in each round: Although IRCC has stated they want to invite thousands of applicants yearly, the exact number will be a key factor in deciding the CRS score cut-off. New Immigration levels plan indicates that Federal High Skilled categories of Economic immigration has target of inviting 82,880 applicants in 2023.
• The number of candidates entering or leaving the pool: Express Entry is in high demand, and the pool of applicants might grow, which may keep the CRS cut-off score high.
• All program vs selective draws: IRCC could alternate between draws that consider all candidates and draws that exclusively consider candidates in particular programs.
• Targeted draws starting in 2023: Beginning in early 2023, IRCC will start holding Express Entry drawings that will choose applicants based on various criteria, including employment, language proficiency, educational background, and more. When this adjustment is implemented, it might drastically alter the CRS score cut-off, for instance, by introducing several cut-offs for different occupations. More information will become available in months to come. 

Other options for international students and work permit holders 

If you are waiting for CRS score cut-offs to lower, you may want to consider some other options. It may be best to wait for the CRS score to reduce, but if you are at risk of becoming out of status, here are 3 options you can consider. 

1. Applying for PNP

Most often, PNP requires you to have a connection to the province. However, you could consider the following programs that do not require you to have a specific connection to the province, but you may need a job offer. New Immigration levels plan clearly states that provincial nominee programs have target of inviting 105,500 candidates in 2023.

Newfoundland and Labrador International Graduate

You could be qualified to apply for a provincial nomination under this program if you’ve completed a post-secondary program of at least two years’ duration anywhere in Canada. Still, you’re now employed in Newfoundland and Labrador. Graduates employed in Newfoundland and Labrador for at least a year on a post-graduate work permit are eligible for the program.

B.C International Graduate

This program can be possible if you have completed a post-secondary degree anywhere in Canada and presently hold a job offer from a company in British Columbia. To be eligible, you also need two years of full-time work experience in a similar role to the job offer. 

Ontario ONIP Job Offer-International Students stream

You may qualify for this PNP if you have a valid job offer from an Ontario employer and have completed a post-secondary program in Canada. Your Canadian education must have been for a study program that lasted at least two years or a one-year course with a prior necessary degree requirement. 

2. Getting an LMIA Work Permit 

If you have worked for a specific employer for a long time, you may ask them to support you with a LIMA. Although the process may be complex, with a valid job offer, you can get more points under the Comprehensive Ranking System.

3. Returning to School

Lastly, you may consider returning to school if you are running out of all options and only need to extend your stay until CRS score cut-offs drop. It is an expensive option, but it can definitely prevent you from leaving Canada. It may help you maintain your status and extend your stay in Canada. 

Getting LMIA-approved jobs in Canada can often be difficult as the employer needs to apply for an LMIA and receive a positive response. Moreover, before hiring a Temporary Foreign Worker for a certain occupation, an employer must obtain a positive LMIA.

In general, Service Canada will issue a positive LMIA if an assessment reveals that hiring a temporary foreign worker (TFW) will positively or neutrally impact the Canadian labour market.

Steps to find LMIA approved jobs using Canada Job Bank 

Step 1: Visit the official Canada Job Bank Website, then scroll down to “Temporary Foreign Worker.”

Step 2: Once you land on the Temporary Foreign Worker page, you will find a “search” button with the number of job postings. Click on this search button. 

Step 3: After you hit the search button, you can view the number of jobs available and filter through the location, salary, language at work and LMIA status. 

Step 4: Within the filter options (on the left), scroll down to “Labour Market Impact Assessment (LMIA) status” and select the check box that says “LMIA approved.”

After following these steps, you will find the list of available jobs that are also LMIA-approved. Then, you can apply online and reach out to employers directly to express your interest or clarify any position query. 

How to find LMIA positive employers?

As mentioned earlier, employers need to apply for an LMIA and receive a positive response to hire a foreign national. If they receive a negative response, they will not be able to hire a foreign national. 

To avoid job fraud and for interested candidates to access information without paying any fee, Employment and Social Development Canada (ESDC) publishes a list of employers who requested an LMIA and received a positive response. 

ESDC publishes the list of employers who received a positive LMIA each year. So whether you are a temporary foreign worker looking for another employer or someone looking to get a job offer, you can refer to ESDC’s list to find potential employers.

According to a new auditor general, Kim Adair’s report, Nova Scotia needs to reform immigration system of the province. The government needs to understand better what immigrants need to settle in the province as the province sets out ambitious goals to increase the general population.

In a report released Tuesday (November 8), Kim Adair stated that the government spends $6.4 million annually on immigrant settlement assistance without understanding whether the money helps prevent them from leaving.

Below are report highlights and findings, in addition to the suggestions made by the auditor general.

More work is needed to meet Nova Scotia’s immigration target

Adair explains that the current retention rate of 70% must be increased to 75%, which would require an increase in yearly population growth of more than twofold, to 25,000 people, from the current 10,000.

The auditor general’s recommendations, such as looking at how settlement financing may best fulfill immigrant needs, are being worked on, according to immigration minister Jill Balser. As more and more newcomers settle in Nova Scotia, Balser said, the services must be flexible and adaptive to serve individual needs constantly.

She added that her agency is also creating two new roles to handle fraud investigations and program compliance checks, introducing 12 new positions to process immigration applications more consistently.

In 2021, Nova Scotia welcomed a record 9,160 immigrants; as of August of this year, that total had already surpassed 9,375 persons.

Lack of evaluation by immigration Department of immigrant required services 

Adair claimed that the Immigration Department had not evaluated the kinds of services required to help immigrants settle in Nova Scotia, adding that the government puts an undue reliance on information obtained from outside sources.

Adair’s report stated that it is very difficult to identify what settlement services are required, which service providers should receive money, and whether any gaps exist without a detailed assessment to evaluate the requirements of immigrants. 

The auditor general said that 18 immigrant settlement companies are currently working in the province, offering services such as language training, employment counselling, and community welcoming initiatives. However, Adair claimed that the government had not thoroughly examined the services given, their locations, or the demand for them.

For instance, according to the report, evaluating whether language training is offered across the province or figuring out whether there is a greater need for particular settlement services in some places than others.

The importance of feedback from immigrants

Adair emphasized feedback from immigrants could help determine where future funding should be directed. In addition, the province has to identify labour market gaps for effective spending to match newcomers to jobs.

While speaking to reporters in an interview, Adair said her department recommended that rather than just being reactionary, a framework should be in place. It would help the government get on top of the issues since it takes time to shift their focused efforts to particular gaps in the labour force. 

Additionally, she said that her audit uncovered inconsistencies in how the province evaluates immigration petitions, leaving the system vulnerable to fraud.

Furthermore, Adair noted that the province intends to increase its population to two million by 2060, requiring improvements in such areas.

Today, Express Entry Draw invited 4,750 profiles to apply for permanent residency (PR). Applicants having a Comprehensive Ranking System (CRS) score of 494 or above received the invitations.

CRS cut off score has reduced by only 2 points as compared to Express Entry draw two weeks ago. Furthermore, number of invites remained same as in the previous draw. This is the 10th all program Express Entry draw this year.

What is Express Entry?

Express Entry system is the fastest way to get Canadian Permanent Residency (PR). It has processing time of 6 months after submission of documents following the ITA.

The Comprehensive Ranking System (CRS), a points-based methodology, is used by Express Entry to rate applicant profiles. The highest-scoring applicants are given an Invitation to Apply (ITA), after which they can submit an application for permanent residence.

The Federal Skilled Worker Program (FSWP), the Canadian Experience Class (CEC), and the Federal Skilled Trades Program (FSTP) all use Express Entry as their application management system (FSTP).

Candidates for the Provincial Nominee Program (PNP) who are in the Express Entry pool are already qualified for at least one of these programmes.

IRCC changed their online processing tool in the beginning of 2022, to offer accurate information on processing timelines. Immigration Minister Sean Fraser announced this modification on March 31, 2022, as part of an effort to improve Canadian immigration system. What Updates Does the Processing Time Include 

IRCC bases processing time on the time it took to process prior similar applications. The processing period begins when the application is received by IRCC and concludes when the immigration officer makes a decision on the application. On November 16, next week, IRCC will implement the new National Occupation Classification (NOC) 2021, the Training, Education, Experience, and Responsibilities (TEER) system. With this implementation, several changes are coming to the Express Entry system. 

These changes will impact Express Entry eligibility. For example, 16 NOC C occupations will become eligible for Express Entry. Additionally, it will also be implemented by all the provincial nominee programs (PNPs). For e.g., 12 NOC codes will become ineligible for the Atlantic Immigration Program (AIP). 

Another change is in the eligibility criteria of the Express Entry. As with NOC 2016 system, an applicant needed to have skilled experience, such as in NOC 0, A or B, to qualify for Express Entry. Next week, with the implementation of NOC 2021, the eligibility criteria for Express Entry will change.

What is the new NOC 2021 and the TEER system?

Canada uses NOC, National Occupation Classification, as a national standard for identifying occupations. After every ten years, the Canadian federal government updates NOC to reflect the country’s labour and economic market changes. 

The old 4-digit “Skill Level” structure will be replaced by the NOC 2021. To illustrate the level of Training, Education, Experience and Responsibilities (TEER) required for a given occupation, new NOC categories are introduced. These new categories include a brand-new five-digit hierarchical structure. 

Understanding NOC 2021 categorisation and the TEER system

Overview of the new TEER categories 

TEER 0: This category includes legislative and senior management occupations with significant experience and knowledge and handles responsibility for directing, resource planning and management. 

TEER 1: This category typically calls for a college/ university degree or prior experience and knowledge in the subject matter from a similar job listed under TEER 2.

TEER 2: This includes occupations with major safety or supervisory duties and typically need two to three years of post-secondary education or at least two years of apprenticeship training.

TEER 3: This includes occupations requiring fewer than two years of post-secondary education, on-the-job training, training courses, or work experience of more than six months.

TEER 4:  Occupations requiring either a high school diploma or no formal education are under TEER 4 category. Applicants with several years of experience in this category may qualify for TEER 3. 

TEER 5: This category is for occupations without formal education requirements. 

Express Entry eligibility requirements with the new TEER system 

To continue participating in Express Entry, you must update your profile with the new TEER system if you haven’t received an invitation to apply (ITA) by November 16, 2022.

Additionally, if you were issued an ITA before November 16, 2022, you must continue to use the NOC 2016 system exclusively.

Expanding efforts to attract francophone newcomers from other countries and provinces are part of Growing Nova Scotia’s Francophone Population – An Action Plan for Success (2022–25). It involves work on the following:

Nova Scotia Immigration Minister Comments 

Minister of Labour, Skills and Immigration Jill Balser says, “The Acadian and francophone communities have been an essential part of our province’s identity and heritage for more than 400 years.”

“Our new action plan demonstrates Nova Scotia’s commitment to increasing the number of French-speaking newcomers throughout the province and ensuring they have opportunities and supports to thrive,” said Balser. 

Moreover, during the Destination Canada Mobility Forum in France and Morocco the following week, Minister Balser will go with a provincial delegation to promote Nova Scotia to skilled French-speaking employees.

Nova Scotia Immigration Goals 

Nova Scotia is making headway in attracting French-speaking residents. 

Since the launch of the first francophone immigration action plan in 2019, the percentage of French-speaking candidates approved under the Provincial Nominee Program has increased from less than 1% in 2018 to 6.4% in 2021.

Additionally, Nova Scotia exceeded its one million population goal in December 2021 and intends to reach two million by 2060.

Bridging Open Work Permits (BOWP) is for people who have filed for permanent residence under the Economic Class. Such as through Express Entry, and currently hold a valid Canadian work permit that expires in less than four months. The work permit holder must also be physically present in Canada to submit the application.

To continue working while waiting for the applicant to obtain PR, the BOWP is an extension of an existing work permit. To be eligible for a BOWP, the applicant must also meet the eligibility requirements.

The applicant may continue to work in Canada under implied status until a decision has been made on the BOWP application if their current work permit expires before receiving a decision on their BOWP application. 

However, the foreign national must stop working in Canada immediately if the application is rejected. Continued employment without a current work permit may jeopardize future applications for permanent residence.

General Eligibility Requirements 

To qualify for a BOWP, the foreign national must meet the following requirements:

• Be inside Canada on a valid temporary resident status. 
• Meet one of the following criteria at the time of your application submission:
  • Hold a valid temporary resident status and authorization to work 
  • Have maintained status and work authorization as a result of applying to renew your work permit

Another requirement is you must have applied for permanent residence under one of the following classes: 

• Federal skilled worker class (FSWC)
• Canadian experience class (CEC)
• Federal skilled trades class (FSTC)
• Caring for children class or caring for people with high medical needs class before June 18, 2019
• Provincial Nominee Program (PNP) for applicants for whom there are no employer restrictions on nominations
• Agri-Food Pilot (AFP)
• Quebec skilled worker class (QSWC)

Your permanent residency application must have completed one of the following stages.

• If you submitted an e-APR electronic application for permanent residency under Express Entry, it must have passed the completeness check. The same applies to the following classes:
  • FSWC
  • CEC
  • FSTC
  • PNP (where the applicant is accepted through the provincial or territorial Express Entry stream)
• APR under the QSWC has passed the section R10 completeness check
• Received a receipt of the positive eligibility assessment on their non-Express Entry APR submitted by mail or online under one of the following classes:
  • caring for children
  • caring for people with high medical needs
  • AFP
  • PNP (where the applicant does not qualify for Express Entry)

Ineligibility for BOWP

In certain circumstances, foreign nationals may not qualify for a BOWP. These circumstances include:

•  Foreign nationals in Canada who are exempt from the work permit requirement 
• Those applying for a BOWP at the port of entry or visa office may be ineligible because they do not have the authorization (yet) to enter as a temporary resident.
  • The fact that applicants are physically in Canada and working while transitioning to permanent residence provides a considerable advantage.
• Spouses and dependents of primary permanent residence applicants as this group can obtain work permits under various LMIA exemption categories.
• Inadmissible foreign nationals 

Officers may make individual assessments of foreign nationals who do not fit the requirements using the more general LMIA exemption.

Required Documentary Evidence 

To evidence eligibility, you must include the following in your BOWP application: 

• Fill out form IMM5710-Application to Change Conditions, Extend my Stay or Remain in Canada as a Worker
  • For the question, “What type of work permit are you applying for?” respond by saying, “Open Work Permit.”
• Pay for the work permit processing fee, the open work permit holder fee, and, if applicable, the restoration fee.
• Provide evidence that you meet the APR (Application for permanent residence) stage corresponding to your permanent residence class and application submission
  • Applicants of the following class receive an approval in principle letter or eligibility letter after obtaining a positive eligibility assessment on their APR. They must provide a copy of this letter with their BOWP application, and these applicants are from the following class:
    • Agri-Food Pilot Program applicants 
    • The caring for children class 
    • Caring for people with high medical needs class 

How to apply? 

You can apply for a BOWP online using the IRCC tool. The tool will ask you questions about your status, and depending on the category you apply under, it will create a personalized checklist. 

Ensure that you select the following when you apply:

• When selecting the work permit type, select “Open work permit.”
• Make the payments for the following:
  • Work permit fee: CAD 155
  • Open work permit holder fee: CAD 100 

After you submit your application, you will receive a letter that proves that you can continue working under the same conditions as your current work permit. However, if you applied to your PGWP, you may not receive this letter.

An official document known as an Acknowledgment of Receipt (AOR) proves that Immigration, Refugees, and Citizenship Canada (IRCC) has received your immigration application. 

IRCC issues an AOR document after you submit an application and the processing time officially begins from the date of AOR. The document’s importance varies based on the application filed and how it is submitted.

When do you receive an AOR? 

Depending on the kind of application, IRCC could release an AOR at different times. One such instance is the automated generation of an AOR for Express Entry, which often occurs minutes after the permanent residence application is filed. 

Contrarily, the AOR for a citizenship or sponsorship application may take weeks or even months.

What does receiving an AOR indicate? 

The AOR is a receipt that confirms that IRCC received your application. However, the date of the AOR is important if the factors below apply to you. 

The age of your dependent children: Only children who match the description of a dependent child may be added to your application. Except in certain circumstances, a dependent child must be unmarried and under 22. Your child must satisfy this requirement by the date IRCC receives your application, as stated on your AOR.

Validity of your document: The validity of some documents, including police records, IELTS test scores, and ECA reports, is limited. Therefore, when your application is received, these documents must be current and valid on the date stated on the AOR. For this reason, ensure that you apply before your documents expire.

Does AOR indicate your application is complete? 

Obtaining an AOR does not always imply that your application is completed or incomplete. It all depends on the kind of application you filed. For instance, IRCC automatically gives an AOR to Express Entry applicants, but they might reject the application if certain papers are missing.

The IRCC has verified that the application is complete if you receive an AOR after filing a citizenship application.

The difference in applying via paper or online 

When IRCC receives your application, they send you a confirmation as an AOR. As a result, the AOR date for a paper-based application will be the day the IRCC mailroom receives your application package. 

Once they begin processing your application, they will send the AOR. To monitor your application and get a confirmation when it arrives, it is crucial to utilize a courier service that demands a signature when delivering it.

The AOR date for an electronic application submission usually coincides with the day you click the submit button. However, due to clerical errors or time zone variances, the date on your AOR may occasionally show to be one or two days later. It is a good idea to submit in advance because of this reason. 

How soon after receiving AOR do you get decision?

The IRCC may not have even begun processing your application when you get the AOR. Receiving an AOR does not essentially mean that IRCC has started processing your application.

AOR is just an acknowledgement by IRCC that they have officially received your application. Therefore, the time it takes to receive PR after receiving your AOR may vary depending on the program you applied for.

Certain applicants start comparing or expecting the decision on their application based on consensus mentioned over the various online forums after receiving the AOR. However, that is not the case. IRCC processing is random and certain applications may take longer than others.

November 4- New Statistics Canada report shows that employment in October increased by 108,000 (+0.6%), recovering losses from May to September. However, the unemployment rate in October remained unchanged at 5.2 per cent. 

Statistics Canada’s new report discusses the changes in employment activities in October 2022. Below, you can find the summary of these changes. 

Summary of changes in employment activities 

Overall, October saw an increase in employment by 108,000 (+0.6%), making up for the losses experienced from May to September 2022. In comparison, the unemployment rate in October stayed the same at 5.2 per cent. 

The industries that experienced an increase in employment were manufacturing, construction, accommodation and food services. But, at the same time, it declined in wholesale and retail trade and natural resources.

Moreover, since March 2022, the number of private-sector employees has increased for the first time. However, employees in the public sector and self-employed workers saw no change in employment.

In addition, employment increased among men and women between the ages of 25 and 54 in October. On the other hand, men and women aged 15 to 24 and those aged 55 and up showed minimal change. 

Generally, employment increased in six provinces, with the most significant increases in Ontario and Quebec. Regarding wages, employee hourly wage growth stayed above 5 per cent for the fifth consecutive month in October, increasing 5.6% (+$1.68 to $31.94) compared to October 2021. 

Following a 0.6 per cent decrease in September, total hours worked increased by 0.7 per cent in October. However, the total hours worked increased by 2.2% compared to October 2021.

About two-thirds of employees with wages more than $40.00 per hour had received a raise in the past year, compared to half (50.1%) of those with wages less than $20.00 per hour (population aged 15 to 69; not seasonally adjusted).

Additionally, over one-third (35.3%) of Canadians aged 15 and older lived in homes that reported trouble meeting financial needs in October, up from one-fifth in October 2020. Lastly, more than 1.7 million Canadians had hybrid work arrangements in October for those aged 15 to 69.

Industries with a significant change in employment 

Employment in construction increased by 25,000 (+1.6%) in October, with increases in five provinces, including Quebec (+17,000; +5.9%) and British Columbia (+6,000; +2.5%). 

Despite this growth, construction employment remained almost unchanged in October compared to March 2022, consistent with the latest GDP data showing slowing economic activity in the industry during a similar time.

Moreover, employment in the manufacturing industry increased by 24,000 (+1.4%), offsetting the 28,000 (-1.6%) decrease recorded in September. British Columbia (+12,000; +6.9%) and Nova Scotia (+3,700; +11.6%) accounted for most of the increase. Manufacturing employment remained relatively unchanged on a year-over-year basis.

Accommodation and food service employment increased by 18,000 (+1.7%) in October, the first growth in the industry since May. However, according to the most recent Job Vacancy and Wage Survey data, the industry had a more significant job vacancy rate in August than all other industries.

Employment in professional, scientific, and technical services increased by 18,000 (+1.0%) in October, the third increase in six months. Since June 2020, the number of people working in the industry has been steadily increasing, and in October, it was 297,000 (+19.3%), higher than before the pandemic.

Moreover, there was also employment growth in “other” services (+18,000; +2.4%) and public administration (+15,000; +1.3%) in October.

In October, the number of individuals employed in wholesale and retail trade decreased by 20,000 (-0.7%). The industry’s employment last rose in May and was a little changed year over year in October. While retail sales grew 0.7% to $61.8 billion in August, advance estimates indicate that sales may fall 0.5% in September.

After three months of minimal change, natural resource employment fell (-6,800; -2.0%) in October, nearly entirely attributable to a dip in Quebec (-6,100; -13.2%).

Other employment trends for October 2022 

In the last year, hybrid employment—the ability to work part-time from home and part-time from a location other than home—has emerged as a viable alternative for employers and employees. 

In October, nearly one in ten (9.0%; 1,746,000) workers reported working both at home and elsewhere, up 0.4 percentage points from September and 5.4 percentage points from January 2022. 

Also, in October, 15.8% of workers worked exclusively from home, an 8.5 percentage point decrease from the beginning of the year (population aged 15 to 69).

The average hourly wages were 5.6% higher (+$1.68 to $31.94) than the previous year (not seasonally adjusted) in October. However, even though average wages have increased by more than 5% year on year in the last five months, they have not kept up with inflation, which was 6.9% in September, contributing to many Canadians’ concerns about affordability and the cost of living.

The proportion of employees who received a raise after being with the same company for at least a year was among the lowest in agriculture (47.2%) and accommodation and food services (49.7%), two areas with average hourly wages below the national average. 

In health care and social assistance (53.6%) and educational services (50.3%), where the majority of employees are unionized, the proportion of employees who received a rise was similarly relatively low.

In contrast, the proportion of employees who had received a rise was among the greatest in manufacturing (67.7%), finance, insurance, real estate, rental and leasing (68.2%), and professional, scientific and technical services (68.4%), three sectors where unionization is often low.

Employment in Canada hit a record high in May, and during the summer, there were record numbers of job openings and record-low unemployment rates in the country’s labour market. 

Consumer inflation in the headlines reached levels not seen in nearly 40 years during the late spring and summer months. In recent times, employment also fell or was flat for four months before increasing in October.

Indeed’s holiday jobs hiring trends report, published on Wednesday, shows that seasonal job posts for this winter are up 28% from last year and 40% above the levels in 2019. While the percentage of job seekers looking for seasonal work is up 25% from last year, it is still slightly below pre-pandemic levels.

According to a recent Indeed study, employers may find it more difficult to find temporary workers during the upcoming holiday season due to the increase in job postings compared to before the pandemic.

The survey stated that while hiring will likely increase generally over the holiday season (November 2022 – January 2023), certain businesses may have trouble filling positions due to increased demand for seasonal workers and job seeker interest.

Possible solutions to finding seasonal workers

Indeed’s Senior Economist Brendon Bernard says the seasonal hiring trend is similar to the rest of the labour market. Employers have reported difficulty filling positions across the sector, and this season, he predicted, will be no different.

Bernard says employers may need to change compensation to attract new hires or provide flexible schedules. 

Nevertheless, he believes it would be challenging to fill certain posts for some specific organizations. He suggests that the question employers must ask themselves is, what are they doing to set themselves apart? 

Moreover, Indeed says that holiday season hiring typically begins in September, but positions for holiday jobs have accelerated early this year. 

The aftermath of the pandemic 

After two years of slowed recruiting due to the pandemic, it is a strong turnaround, says Bernard. There has been a little more return to normal this year, says Bernad. However, he said it’s likely that employers are getting ready for an expected increase in foot traffic.

Indeed report shows that the market’s overall share of seasonal employment is 1.3 per cent, higher than in 2021 but not nearly at pre-pandemic levels. In 2022, Canada’s overall job postings will have reached record highs, indicating a more competitive employment market, particularly in some industries.

Further, seasonal employment for customer service agents and sales associates is concentrated in the retail sector. Indeed data shows that customer-facing retail jobs make up half of this year’s seasonal postings.

Other Expert Opinion 

Michelle Wasylyshen, the spokesperson for the Retail Council of Canada, says the labour shortage is a persistent problem in retail.

She explained that retailers are anxious about their ability to ramp up staffing numbers with the approaching Christmas shopping season and significant shopping occasions like Black Friday, Cyber Monday, and Boxing Day.

There has been a decrease in the pool of part-time workers, which Wasylyshen says is one factor causing the retail labour crisis. Throughout the pandemic, “fewer seniors and young people returned to the workplace,” she said.

How to apply for proof of Canadian citizenship?

Therefore, to ensure that you get points for your experience, check if your reference letter includes your main duties, which align with your NOC’s description and main duties. Additionally, if you have a new job offer while your permanent residency application is processing, make sure that you update your profile according to the new job offer.

Another critical point to remember is that from November 16, IRCC will implement the use of the new NOC 2021 to assess all applications. 

Alternatives to the employment reference letter 

A job reference letter is the most suitable evidence you can provide to claim points. However, in circumstances where the company is no longer operating or your point of contact is not with the company anymore, there are certain alternatives you can consider. 

The following is alternative evidence that may help your application: 

• Pay stubs 
• Tax forms 
• Offer of employment 
• Personal letters from co-workers 
• Bank statements with pay deposits 
• Any media references with your name on the company can include social media posts welcoming you as a new hire 
• Affidavit from your former supervisor or co-worker, including their official ID and business cards 
• Include a letter explaining why you could not get a job reference letter.

As IRCC backlog continues to grow out of control, there are a few things you could do as an applicant to prevent your application from being stuck in the “Review Required” phase. 

Ordering Global Case Management System notes is one of the common practices to know the status or details of your application. You can get the notes by accessing information requests to IRCC via mail or online. The notes provide an overview of the processing details of your immigration/visa application.

Candidates can view specifics of the IRCC’s case evaluation through these notes. The evaluation looks at eligibility, local or international human rights violations, medical issues, criminal activity, etc. 

These notes sometimes reflect a “review required” flag. The phrase “review required” theoretically enables a junior IRCC analyst to draw the attention of a more senior visa officer to a specific problem and seek action, such as rejecting the application or requesting more supporting documentation.

However, in reality, it just means that when the IRCC slowly attempts to clear its application backlog, your file is more likely to get trapped at the bottom of the stack. Unfortunately, as a result, anything that requires more thought or extra effort is delegated lower on the list of priorities and frequently set aside for review at later time.

The issue for the IRCC is that visa officers are overwhelmed by a volume of applications, frequently leaving no one with the capacity to handle the more complex “review required” applications.

Three reasons why your application may receive a “review required” flag 

Lack of sufficient funds 

Candidates must demonstrate they have the financial resources necessary to settle in Canada to be considered for one of the permanent residence streams. If IRCC staff believe that fluctuations in foreign exchange rates have reduced an applicant’s cash holdings below the Canadian dollar threshold, they may flag the file for review. 

Another reason may include providing incorrect supporting documents, such as non-liquid assets like bonds or real estate, to satisfy the criteria.

Typically, the applicant will receive a notice and an opportunity to respond to a procedural fairness letter when currency fluctuations arise. Failure to meet the proof of funds requirements and response to the letter may result in the application’s rejection. 

When you first notice a “review required” flag, it is best to take proactive steps to resolve it as soon as possible rather than waiting for IRCC to reach out. Depending on the category that received the review required tag, you should provide updated or more information to IRCC. 

For example, if proof of funds is an issue, you should present updated bank statements proving your financial stability, preferably with enough extra funds to cover future currency fluctuations.

Employment history 

Visa officers may flag the file for review if they believe your work experience is not verifiable or if there is a discrepancy between the employment confirmation documents and the qualifying NOC description.

In addition, a skilled worker’s eligibility is correlated with employment offers in specific National Occupation Classification (NOC) jobs. To prevent the problem, ensure that you provide additional evidence or a sworn declaration outlining the probable problem.

Inadmissibility

Foreign nationals may be inadmissible to enter Canada for various reasons, such as past criminal activity abroad or domestically, health concerns, or application fraud. 

When a person has previously been denied entry to Canada or any other country, IRCC officials frequently demand a review to determine whether the denial raises new concerns about their current admissibility.

Hence, revealing prior visa denials or immigration problems is crucial. However, not revealing may be viewed as a misrepresentation that could make you inadmissible to Canada for five years. 

Additionally, even if you provided more information after receiving the dreaded notification that a review is required, your file would probably still be at the bottom of the list. Therefore, ensure that you reveal all past visa rejections and entry denial along with a proper explanation to avoid getting flagged.
